Intellectual Property of All Artworks Completed by Bethany Neck
All products, artwork & writings completed by Bethany Neck Artist remains the intellectual property (IP), including all Rights & Copyright, of Bethany Neck.
Usage and Reproduction:
The use and reproduction of images for the benefit of Bethany’s business for commercial purposes will be considered on request. Please email: artbethany@icloud.com
Bethany Neck Artist business & website complies with the Australian Consumer Act.
The following clauses were written in Feb ’24 in consultation with a 'Lawpath' lawyer, to ensure all disputes are settled out of court, with mediation. Bethany Neck Artist is only financially responsible for the return of the cost of goods (only), if liable.
Sold Exhibition Works
Once the artwork has been paid for and collected, it is the purchaser's sole responsibility to insure it. Loss, theft or damage of any description on collection or in transit from the place of exhibition, is the sole responsibility of the purchaser.
IKEA Frames for Watercolours:
Bethany uses new IKEA frames for her watercolours and shetches, with non- acidic plastic windows, instead of glass, for her watercolour exhibition works. They are light frames that can be posted to customers. Bethany adds Framers' D hooks with plastic coated wire, to ensure artworks hang safely, with felt stickers added to the bottom corners. These frames may need repacement over time.
The Finance Merchant that Handles Credits and Refunds on this Platform
A percentage of money is taken from the financial ‘processing merchant’ dealing with credit and refund facilities on this platform. A refund will be paid to the customer, with a percentage deducted by the merchant, not Bethany Neck Artist, for processing refund transactions. The resultant amount will be forwarded to the customer.
‘Dispute Resolution’ Limited Liability Clause for Bethany Neck Artist Under Australian Consumer Law
Selling to People Overseas or Interstate Australia - Mediation or Arbitration will be Out of Court in the City of Adelaide, SA.
‘Mediation is Binding’ Clause
If a dispute cannot be resolved, mediation will occur between Bethany, the consumer (or third party) and a legal representative, in Adelaide city, SA or via online facetime, with the final decision being binding.
Otherwise, it will be necessary to come to Adelaide, SA to hold an ‘out of court’ mediation procedure, where arbitration occurs.
Note: Bethany Neck Artist will only be ultimately liable for the replacement or cost of the original item/s of purchase (or return), only.

Packaging and Shipment
Information on shipping costs, estimated delivery times and shipping methods are listed on the website. All materials and artworks are checked carefully, photographed and packaged to ensure their quality and safe transit to your designated shipping address. We work with reliable shipping partners to minimize the risk of damage during transportation.
Deliveries Are Tracked
All artworks and stock are tracked for customer ease of mind. As soon as a payment goes through to finalise a sale, they are wrapped according to weight, fragility and size, ready for pick up or delivery. We will do our best to have stock packed and delivered quickly, however please allow 28 days for the delivery of artworks or goods, as we work with independent companies.

Inspection Upon Delivery
Upon receiving your art piece, we strongly recommend inspecting the package for any signs of damage. If the packaging appears compromised, please document the condition with photographs and contact our Customer Support immediately, artbethany@icloud.com
Replacement or Refund
Upon receipt of your report, we will assess the situation promptly. Depending on the circumstances, we will offer one of the following resolutions:
Replacement if possible: If the merchandise or art work is in stock, we will ship a replacement as soon as possible.
Refund: If a replacement is not available, or if you prefer, we will initiate a refund for the purchase amount.
Refunds and Return of Damaged Items or Items Not Received via Professional Transport Services.
In the unfortunate event that your purchased art piece, transported by Australia Post or a Private Courier Service, arrives damaged please report the issue to: artbethany@icloud.com within 7 days of receiving the item.
Provide detailed information, including the receipt or order number, with a description of the damage, and supporting photographs.
In some cases, we may request the return of the damaged item. If so, via email, we will provide detailed instructions on the return process and any associated shipping costs for the return will be covered by Artist Bethany Neck.
Items Not Received
If the item bought is not received, please contact artbethany@icloud.com.
Refunds or returns are limited to strictly 30 days after receiving any goods purchased from www.bethanyneckartist. Change of mind is not an acceptable reason for a return or refund.
Information on the Credit Card Refund Process and Any Associated Fees
Bethany Neck will use the credit card details provided at the time of sale to process a refund, unless new bank details are advised by the original purchaser.
Exceptions
